eMock LTD

These Terms of Use (“Terms”) govern your access to and use of the eMock platform and related services provided by eMock LTD (“we”, “us”, “our”). By accessing or using the eMock website or application, you agree to be bound by these Terms. Please read them carefully.

1. Interpretation

In these Terms of Use, “we” means eMock LTD (Company number 10088529); “you” means our customer or user; and “services” means all features, software, and digital materials available through the eMock platform.

2. eMock Services and Features

eMock is an innovative exam preparation platform designed for primary and secondary school entrance examinations. Our products are digital in nature and include access to online study materials, mock exams, and AI-assisted learning tools. We reserve the right to modify or enhance our services at any time to maintain quality and compliance.

These Terms may be updated periodically to reflect regulatory or operational changes. The latest version will always be available on our website.

3. General Terms

  • We handle your personal information in accordance with our Privacy Policy.
  • All intellectual property rights in the eMock platform and services remain the exclusive property of eMock LTD.
  • Parent Accounts: Only parents or legal guardians may register and create accounts. Parents may add and manage pupil profiles under their account.
  • Pupil Accounts: Pupils do not create accounts themselves. All pupil data is managed through a parent account. We do not knowingly collect data from minors without parental consent.

Available Plans:

  • eMock Free Plan: Free access with limited features available to all registered users.
  • eMock Elite Plan: Paid access available as either a 6-month or 12-month plan. Elite plans unlock all premium platform features.

All plans are purchased directly by parents. Upon activation, access is automatically applied to the parent and linked pupil profiles.

Payment Processing: All payments are handled securely by PayPal or Stripe. We do not store card details. Transactions occur on the provider’s secure checkout pages. We may receive confirmation of payment, transaction IDs, or receipts for administrative purposes.

We reserve the right to refuse service or terminate access to any user if fraudulent, abusive, or unlawful activity is detected.

4. Price and Payment

  • Plan prices: Plan prices are displayed clearly on the eMock website. Price changes will not affect any active plan.
  • Payment Type: All plans are prepaid and valid for the selected duration (6 or 12 months).
  • Currency: All payments are made in British Pounds (GBP).
  • VAT: Prices include VAT and applicable taxes.

5. Plan Duration and Refund Policy

  • Plan Duration: Each paid plan lasts for the duration selected at purchase — either six months or twelve months. After the plan expires, the account automatically reverts to the Free Plan. Users can then renew or upgrade again at any time.
  • No Cancellation Required: Because access is time-limited, there is no need to cancel. The plan simply ends when the chosen period expires, ensuring a smooth transition back to the Free Plan.
  • No Refund Policy: eMock plans are non-refundable. Before purchase, all users can freely access the Free Plan, which allows them to explore and experience the platform interface, question types, and key features for selected items. This ensures every parent and pupil can make an informed choice before upgrading. Once a plan is purchased and activated, full access is granted immediately, and refunds are only considered in the event of proven billing errors.
  • Billing Errors: If you believe an incorrect amount was charged, please contact support@emock.co.uk. Verified overcharges will be corrected or credited where applicable.

6. Intellectual Property Rights

All ownership and intellectual property rights in the eMock platform, software, website, and associated materials remain vested in eMock LTD. You are granted a limited, non-transferable licence to use the platform for personal, non-commercial purposes in accordance with these Terms. You must not copy, reverse-engineer, or distribute any part of our content or software without prior written consent.

Some components of the platform may include open-source software governed by their respective licences. Where applicable, those licence terms apply in addition to these Terms.

7. Limitations of Liability

  • eMock provides all services “as is” without warranties of any kind.
  • We are not liable for indirect, incidental, or consequential damages, including loss of data, profits, or goodwill arising from your use of the platform.
  • Our maximum liability is limited to the amount you have paid for your current plan.

8. Indemnification

You agree to indemnify and hold harmless eMock LTD, its officers, employees, and agents from any claims, damages, or expenses arising from your misuse of the platform or violation of these Terms.

9. Termination and Suspension

We may suspend or terminate your access to eMock at any time if you breach these Terms, misuse the platform, or engage in fraudulent or unlawful activity. You may contact support@emock.co.uk for assistance with account removal or data deletion. Upon termination, all rights granted under these Terms will cease immediately.

10. Other Restrictions

You may not:

  • License, sell, share, or resell the platform or its content.
  • Copy, modify, reverse-engineer, or attempt to extract source code.
  • Upload, transmit, or distribute spam, malware, or any harmful code.
  • Use the platform for unlawful, fraudulent, or abusive purposes.
  • Attempt to disrupt, overload, or interfere with the operation or performance of the platform or its connected systems.

eMock reserves the right to investigate misuse and cooperate with law enforcement if necessary.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
